1. Why do I need a Maritime Jones Act lawyer?

1. What is the Jones Act?

The Jones Act, 46 U.S.C. Section 30104 et seq., is a law that is still favorable to an injured worker. It applies to all persons that are involved in the maritime offshore industry or inland waterway river commerce system. It applies to the fishing, fishery, canning, shrimping, oil field, dredging, barge, tugboat, towboat, crew boat, supply boat, drill ship, platform, oil rig and other maritime offshore industries. The Jones Act allows you to actually sue your maritime employer for negligence and/or “unseaworthiness” for any injuries you suffer including, a back injury, neck injury, herniated disc, brain injury, burn injuries, hurt shoulders and knees, inhalation injuries and wrongful death claims. The fact that you can sue your employer is the major difference between the Jones Act and workers compensation claims.

2. What Is “Unseaworthiness” or “Unseaworthy”?

As indicated above, you can sue your employer for negligence or you can allege that a piece of equipment was unseaworthy and that was a cause of your injury. But what is unseaworthiness? Literally, it means that the particular piece of equipment “is not fit for its intended purpose”.

3. You can also sue under a theory of negligence.

In addition to “unseaworthiness” as a theory of recovery under the Jones Act, you can also sue the employer alleging that a crewmember was negligent and that was the cause of your injuries.

4. What is “Maintenance” and Medical “Cure”?

This is an obligation that is owed to you directly from your employer and is different from the Jones Act. Maintenance is an obligation to pay you a daily amount while you are injured and usually is an amount equal to the cost of lodging and food when you were aboard the vessel. It varies. We have seen it as low as $8.00 a day and as high as $50.00 a day. Medical “Cure” is reasonable and necessary medical care that the employer must pay you yntil you reach maximum medical improvement [MMI].

There are three (3) main points that Gordon & Elias, L.L.P. wants you to understand about Maintenance and Cure. First, they not only apply to injuries suffered while working but also to illness. Second, unlike the Jones Act, they should be paid regardless of fault. In this sense they are very akin to workers compensation. Third, if the employer wrongfully refuses to pay them, the maritime employer can be liable for punitive damages as well as attorneys’ fees.

5. “Comparative Negligence” Applies Under Jones Act

Another concept to understand about the Jones Act is that it applies the legal doctrine of “comparative negligence”. Under a “comparative negligence” approach, the jury hears testimony about the negligent conduct of both parties–the employer and the maritime worker. Based on the evidence, the jury will determine what the injured party’s damages are and how much should be allocated to each party. Sometimes accidents happen not just from the employers’ negligence but also from the seaman’s as well. The good thing about “comparative negligence” is, even though the jury may find a percentage of negligence on the worker, the injured worker still recovers the percentage of the jury’s monetary award that is equal to the employers’ percentage of negligence. By way of example only, if the worker is found 25% negligent and the employer is found 75% negligent and the jury awards $875,000.00, then the judgment would be that the worker recovers $656,250.00 plus costs. This is quite different than in almost all states where, if the injured person is found 51% or more negligent by the jury, the injured person would recover zero no matter how much the jury awarded for money damages.

6. When Must I file Suit?

The Statute of Limitations in a Jones Act claim is three (3) years from the date of injury. A Jones Act lawsuit must be filed within three (3) years of the injury date or it is barred by the Statute of Limitations.

As you can see, a maritime claim is a very specialized area and should only be handled by lawyers who know what to do.

I looked up at my painting. It was of the beach Alli and I was at for the day. My wife, Katie, was at the hotel. We had all just driven to Frazie’s Beach in Florida all the way from Tuscan, Arizona! We had made little stops until Alli had wailed, “Dad! I REALLY got to go!” which we then stopped at the nearest gas station to use the public restrooms. Other than restroom breaks, we used the food from our cooler, Katie and I sand along to the 80’s station, and Alli listened to the Ipod she had gotten for Christmas.
The trip took three days. Occasionally, Katie would get nauseated from her pregnancy, but she thankfully hasn’t gotten sick yet.
I looked back at Alli. She wasn’t there.
I was out of my lawn chair in a second.
“Alli?” I panicked.
I went down and up the beach, into the water, as far out as I could go. I was crying, I was laughing hysterically, I was screaming, I had lost it.
“Hey, you!” The lifeguard shouted. “ Don’t go out that far!”
He started rushing toward me as I screamed, “My daughter!” and fainted in the water.

“This must be heaven.” I pondered.

“No!” I shouted. I sat up and looked around me. I had an IV connected to my right arm and a bandage on the back of my head. “What?” I trailed off.
Kate explained that when I learned of Alli’s death, the truth hit me so hard, that I fainted.
“I was so afraid I had lost both of you!” Kate finished.
At this point, Kate walked over to me and burst into tears. We were both crying when the doctor came in and said that after a few tests, we could go back to the suite.
“But you are strictly to be on bed rest for 48 hours, because of your heart condition.” He informed us.
“My heart?”
“Yes, your heartbeat dramatically dropped very low when you got here.” He said. “ Oh, and no caffeine for about a week or the results could lead to a heart attack.”
Kate’s eyes were swollen by the time we got back to our hotel, Patrick’s Suites.
“Your mother called while you were in the infirmary.” Kate motioned for me to get the key out of the back seat. “She insisted on paying for our stay here, and she said she’s coming down from Maine within a few days.”

Senator Bill Nelson of Florida has Proposed a FEDERAL BAN on ALL Pythons. S373 is a Very Simple Bill that calls for no Appropriations (funding). That makes it Dangerous because it would be so easy to pass without any real consideration. We must take Action NOW to try and STOP this Bill from passing as written.
What it is:
S373 is a Federal Ban that would effect ALL pythons in EVERY State.
This Bill is an effort to bypass the established process of ‘Rule Change’ to the Injurious Wildlife List of the Lacey Act that was initiated by the South Florida Water Management District last year. This process is moving into it’s second year and is ongoing. USARK warned last April at the ‘Herp Summit’ in Chicago that a political move was afoot to go around the normal ‘Rule Change’ process. Although ridiculed by some as “Not Possible”, S373 proves that prediction true.
This is an issue regarding Burmese Pythons living feral in South Florida. No other species. No where else. Other pythons have nothing to do with feral populations of Burmese Pythons in South Florida.
S373 has been moved into the Water & Wildlife Sub- Committee. It will be heard there and if given a favorable rating move back to the full Environment & Public Works Committee. (see contact info below)
What it isn’t:
This is NOT HR669 the other Federal Bill that we have been campaigning against.
There is NO Scientific Evidence to support the premise that passing S373 will have any impact whatsoever on the Burmese Python situation that is confined to the Southern tip of Florida.
There is absolutely NO Evidence of any kind to support that this is a problem anywhere outside of South Florida.

I oppose S373 as written. The Burmese Python issue is a South Florida issue not a National one. There is No credible evidence to show that these animals can exist north of Lake Okeechobee. Many different species of Pythons have been imported into the US over the last 50 years. The only pythons that have been established have been Burmese Pythons, but only in South Florida; no where else. No evidence exists anywhere to suggest that Banning all Pythons will have any positive impact on the effected area in the southern tip of Florida.
Banning all pythons nationwide would have a devastating effect on an already troubled economy. It would destroy thousands of hardworking American families and small businesses. Not just the breeders and dealers but hobbyists, dry goods, equipment manufacturers, food providers, shippers, trade shows, hotels and restaurants. To overlook the crushing blow this would have to an entire segment of the economy is irresponsible.
